101.123 Wisconsin Act 12 When a county, city, village, or town enacts an ordinance or a school district adopts a policy to regulate or prohibit smoking in certain outdoor areas, the ordinance will apply solely to public property within the jurisdiction of the respective county, city, village, town, or school district. The ordinance must allow the operator of a restaurant, tavern, private club, or retail establishment to designate an outdoor smoking area that is a reasonable distance from any entrance to the establishment. However, the ordinance cannot specify what constitutes a "reasonable distance" or prescribe a specific measurement for it.
