Texas Penal Code Chapter 48.01: A defense against prosecution under this section is that the conveyance or public place where the offense occurred did not have a prominently displayed, reasonably sized notice indicating that smoking is prohibited by state law in that conveyance or public place and that a violation is subject to a fine up to $500.
