Texas No Guns Signs
Relevant Texas Statutes
Property and business owners must post signs specified by the Texas Penal Code to prohibit the carry of firearms within their premises:
- Post Texas 30.05 Signs to prohibit carry of firearms by persons without a license (effective 09/01/2021 per HB 1927),
- Post Texas 30.06 Signs to prohibit concealed carry by persons with a license,
- Post Texas 30.07 Signs to prohibit open carry by persons with a license.
Texas Gov’t Code § 411.207 (b) A peace officer who is acting in the lawful discharge of the officer's official duties may temporarily disarm a license holder when a license holder enters a nonpublic, secure portion of a law enforcement facility, if the law enforcement agency provides a gun locker where the peace officer can secure the license holder's handgun. The peace officer shall secure the handgun in the locker and shall return the handgun to the license holder immediately after the license holder leaves the nonpublic, secure portion of the law enforcement facility.
Texas Penal Code § 46.03 Places Weapons Prohibited (a) (a) A person commits an offense if the person intentionally, knowingly, or recklessly possesses or goes with a firearm, location-restricted knife, club, or prohibited weapon listed in Section 46.05(a): (1) on the premises of a school or postsecondary educational institution, on any grounds or building owned by and under the control of a school or postsecondary educational institution and on which an activity sponsored by the school or institution is being conducted, or in a passenger transportation vehicle of a school or postsecondary educational institution, whether the school or postsecondary educational institution is public or private.
Texas Penal Code § 46.11. PENALTY IF OFFENSE COMMITTED WITHIN WEAPON-FREE SCHOOL ZONE. (a) Except as provided by Subsection (b), the punishment prescribed for an offense under this chapter is increased to the punishment prescribed for the next highest category of offense if it is shown beyond a reasonable doubt on the trial of the offense that the actor committed the offense in a place that the actor knew was: (1) within 300 feet of the premises of a school; or (2) on premises where: (A) an official school function is taking place; or (B) an event sponsored or sanctioned by the University Interscholastic League is taking place.
